Terms and Conditions
1. The Principle Guest must be a minimum of 21 years of age and will be responsible for their party and for them complying with these terms and conditions.   The Principle Guest is the person who requests to rent the home and with whom all communications regarding the rental agreement will be made unless otherwise stated. The words “You” & “Your” in this document refers to The Principle Guest.

2. The Pool Home is rented out as a privately owned vacation home and complies with all licences and regulations required by the US government, Florida State and Osceola County for a maximum of 8 guests.   It is located in the established residential and vacation community of Indian Ridge.   The Indian Ridge Community Home Owners Association has legal control over environment, appearance and development of all properties and communal areas.   While in residence at the home your party are expected to comply with all laws and regulations in place at the time. Examples of enforceable restrictions are:- no nude or female topless sunbathing in public view, no making excessive noise late at night, no parking on lawns or over night on the road.   Smoking inside the home and pets are not permitted.

3. A 10% deposit is required at the time of booking.   Full payment is required 10 weeks prior to start date of rental period.   On receipt of the final payment the directions and access instructions for the home will be provided.   If full payment is not received by the due date, the booking will be cancelled and the deposit refunded minus £20/$40 administration fee and any credit card charges.

4. Price includes 13% Florida Sales & Tourist Development taxes and standard exit clean unless otherwise stated.

5. A refundable £150/$250 property loss/security deposit is required with final payment or on arrival.   This will be refunded within 28 days after the rental period but subject to notified deductions where there is accountable property loss, damage, additional cleaning or unpaid charges/fees.   On arrival you should check the property, furnishings, and other household contents are in a good and serviceable condition and nothing is missing from any inventory list supplied.   Where you find something is damaged or missing you need to report it at the earliest opportunity to Magical Memories.   You will not be charged for fair wear & tear or equipment failure unless it failed through your intentional or negligent misuse. You will be notified within 14 days of anything you are to be charged for and you will be given the opportunity to challenge the reason and/or cost, and this taken in to account before making a final decision on any charges.

6. Cancellation by you: within 10 weeks of the rental start date, only the property loss/security deposit, pool heating and any cot /high chair payments will be refunded. Refunds will be made within 14 days of written notification being received less any credit card charges.   Cancellation 10 weeks or more before the rental starts will receive a full refund within 14 days of written notification being received less £20/$40 administration fee and any credit card charges.

7. Holiday Insurance is recommended when booking any part of a vacation to avoid financial loss due to unforeseen circumstances leading to cancellation, personal property loss and or medical treatment.   The owners and Magical Memories accept no liability for such loss out side of their control.

8. If there is a change in property availability prior to the start of your rental we shall advise you of the circumstances and try to find a similar property for you to rent or refund your monies in full.   If while you are in residence the property becomes uninhabitable as determined by Magical Memories, then any cost incurred by your party’s relocation through Magical Memories up to the value of the booking will be borne by the owners except where members of your party have caused the property to be uninhabitable, in which case your rental agreement will be terminated and no refund will apply.   In the unlikely event you are unable to reside in the home through reason of ‘Force Majeure’, such as but not limited to:- Riot, strike, civil war, war, terrorist activities, the owners or Magical Memories will not be liable or responsible to provide, find or pay for alternative accommodation.

9. Bed linen, bath and pool towels are provided sufficient for the number of guests expected. An initial supply of toilet paper and soap are provided but no food, beverages or other household consumables.   You are advised to buy bottled water for cold drinks.

10. Cleaning is only done prior to each let.   If you request a clean through Magical Memories during your stay, a minimum charge of $75 will be payable locally.   The pool and pool deck are cleaned weekly.   Guests are required to leave the home in a reasonable state, dishes washed and beds striped.   A charge will apply if your party causes the need for a special or additional cleaning.

11. Final exit: to allow sufficient time for cleaning of the home prior to the arrival of the next guests you are required to vacate the home by 10AM local time.   A charge of $50 will be made if your party has not left by 10AM.

12. Security of the home must be maintained during and at the end of your stay by use of locks and the security system.   On your final departure, after fully securing all doors, windows and setting the alarm, you must return the door key to Magical Memories Office.   At no time must keys or codes relating to the security of the home be given to others outside your party.

13. Maintenance of the home by Magical Memories staff or agents may need to be done during periods of occupancy.   You are required to allow reasonable access to permit service or repair to the property, its assets and utilities. Always verify they are staff or agents.
